The Maliki madhab takes the strictest position a secret nikah is completely invalid. For them public announcement is not just recommended, it is a condition of the marriage itself. If the witnesses are told to stay quiet, the entire contract falls apart. The Hanafi, Shafi’i and Hanbali madhabs say the nikah is technically valid as long as two witnesses were present but deliberately hiding the marriage is sinful and goes against the sunnah of the Prophet ﷺ who specifically encouraged announcing marriages openly.
